Terms of Service

This Privacy Policy explains how we collect, use, share, and retain personal information when you use our websites, products, and services (the “Services”).

By using the Services, you agree to this Policy. For data processing on behalf of business customers, our Data Processing Addendum (DPA) governs (see https://salespigeon.ai/legal/dpa).


1) What We Collect

Account & Billing: name, business details, email, phone, plan info; limited billing metadata (payments are handled by Stripe).

Call Data: call audio, transcripts, caller ID/phone numbers, names/emails/addresses provided during calls, appointment/scheduling details, CRM/calendar data you connect.

Integrations: data from services you enable (e.g., Google Calendar, CRMs, Stripe metadata).

Technical Data: IP address, device/browser info, log files, and cookie/SDK data (see Cookies & Analytics).

Support/Comms: messages you send us (support tickets, emails).

Sensitive data. We do not intend to collect sensitive personal information. If you use the Services in a clinical context, see PHI/HIPAA below.


2) How We Collect It

  • Directly from you (account setup, support, in-product forms).
  • From callers interacting with voice agents.
  • From integrations you connect (Google Calendar, CRMs, Stripe).
  • Automatically via cookies, pixels, SDKs, and logs.

3) How We Use It

  • Provide & operate the Services (voice handling, routing, live transfer, analytics, support).
  • Security & integrity (fraud prevention, troubleshooting, auditing).
  • Billing & account administration.
  • Product improvement: we may use de-identified/aggregated data derived from Client Data to train, test, and improve our models and Services. We do not attempt to re-identify individuals.
  • Marketing & communications (service announcements, offers consistent with your settings).

For processing on behalf of a customer (business client), we act as processor/service provider under the DPA (https://salespigeon.ai/legal/dpa).


4) PHI / HIPAA (Healthcare Contexts)

Elios AI is not intended to process PHI unless you have executed a Business Associate Agreement (BAA) with us and enabled HIPAA settings. Without a BAA, you must not use the Services to handle PHI. Contact us to discuss HIPAA enablement.


5) How We Share Information

We do not sell personal information. We may share with:

  • Service Providers/Subprocessors that help us run the Services (e.g., Stripe for payments; Google for calendar sync; Twilio for telephony; MongoDB Atlas for hosting/storage; a transactional email provider). See Subprocessors at https://salespigeon.ai/legal/subprocessors.
  • Professional advisors (legal, accounting), legal authorities as required by law, and in connection with corporate transactions (merger, acquisition).

We do not permit service providers to use personal information for their own advertising.


6) Targeted Advertising (“Sell/Share”) & Your Opt-Out Choices

We may use pixels and audience tools (e.g., uploading hashed customer/lead lists or enabling retargeting) to run cross-context behavioral advertising about our Services. This may be considered “sharing” (and, in some states, “selling”) personal information for advertising purposes.

  • Opt Out: You can opt out of targeted advertising and the sale/share of personal information via /privacy/opt-out at https://salespigeon.ai/privacy/opt-out.
  • Global Privacy Control (GPC): If your browser sends a GPC signal, we will treat it as an opt-out for that browser.
  • Preferences: You can also adjust cookie settings via our banner (when present) and your browser ad settings.

We do not use end-consumers’ call content for third-party advertising. Our ad programs relate to our own customers and leads.


7) Cookies & Analytics

We use cookies/SDKs for:

  • Essential operations (security, login, session continuity).
  • Analytics (e.g., Google Analytics) to understand usage and improve features.
  • Advertising/retargeting (when enabled) to measure performance and reach audiences.

Controls:

  • Manage preferences in our cookie banner (when present) and your browser settings.
  • Opt-out of targeted advertising via /privacy/opt-out at https://salespigeon.ai/privacy/opt-out; we honor GPC signals for supported jurisdictions.

8) Call Recording & Consent

If you enable call recording/transcription, you are responsible for providing any legally required notices and consent to callers in the jurisdictions where you operate. We provide configuration tools to support your compliance.


9) Data Retention

We retain personal information as long as necessary to provide the Services and for legitimate business purposes. By default, Client Data may be retained indefinitely unless the customer requests deletion. Backups are overwritten on normal cycles (target ~90 days).


10) Security

We implement technical and organizational measures designed to protect personal information, including encryption in transit and at rest, access controls (least privilege, MFA), audit logging, backups and recovery, vulnerability management, and periodic security testing. 11) Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, or port your personal information, and to opt out of targeted advertising/sale/share.

  • If you are an end-user/caller of a business that uses Elios AI: Please submit requests to that business (they are the controller). If you contact us directly, we will forward your request to the business and assist them in responding.
  • If you are our direct customer: Email support@salespigeon.ai. We aim to respond within 45 days (or as required by law).

Appeals: If we deny a request, you may appeal by replying to our decision email.


12) Children

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children.


13) International Transfers

We process and store personal information in the United States and use US-based subprocessors.


14) Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will notify you (e.g., email, banner, or in-app notice) and update the Effective Date above.
